Freeplay Music – Online Privacy Policy

This Online Privacy Policy (the “Policy”) applies to information obtained by Freeplay Music, LLC (“Freeplay” “we” or “us”) when you visit freeplaymusic.com (the “Site”). This Policy also describes how we may share the information we obtain, your choices regarding our use of your information, the ways in which we safeguard such information, and how you may contact us regarding our privacy practices.

 Information You Provide to Us

 We collect information you provide directly to us through the Site. For example, we collect information when you create an account on the Site, purchase a product, download a product, or contact us. The types of information we collect may include personal information, which is information that can be used to identify you such as your name, mailing address, phone number, email address, payment card information, social media website username, or any other such information you choose to provide.

 Information We Collect Automatically

 In addition to information that you submit to us, we may collect certain information using automated means (such as cookies, web beacons, and web server logs) when you access or use the Site. This information may include your IP address, demographic information, operating system characteristics, data about how you use the Site, and details about your hardware (e.g., your computer or mobile device), such as unique device identifiers, type, model, version, MAC address, device or session ID, functionality, performance data, and connection type. We also may collect clickstream data, which is information about the page-by-page paths visitors take as they browse through the Site.

The methods that we, and our service providers, may use to collect information automatically include:

  • Cookies: Cookies are data files that are placed on a computer when it is used to visit a website.   • Web Beacons: We may include small graphic images called web beacons, also known as “Internet tags” or “clear gifs,” on the Site and in email messages. We may use web beacons or similar technologies for a number of purposes, including counting the number of visitors to the Site, monitoring how users navigate the Site, and verifying how many emails that we sent were actually opened or how many particular articles or links were actually viewed.
  • Embedded Scripts: An embedded script is programming code that is designed to collect information about your interactions with the Site. It is temporarily downloaded onto your computer from our web server (or the server of a third party with whom we work), is active only while you are connected to the Site, and is deleted or deactivated thereafter.

These technologies help us better understand user behavior, tell us which parts of the Site people have visited, and facilitate and measure the effectiveness of advertisements and web searches.

In some of our email messages we use a “click-through URL” linked to content on the Site. When a user clicks on one of these URLs, they pass through a separate web server before arriving at the destination page on the Site. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked in this way, you should not click text or graphic links in email messages.

Information we automatically collect about you through the Site may be combined with your personal information. If we do combine non-identifying information with personal information, the combined information will be treated as personal information for as long as it remains combined.

We and our business partners or other third parties may use information about you obtained through the Site to send you promotional materials related to your interests or purchase trends as identified using automatically-collected data.

Data Analytics

The Site may use third-party web analytics services, such as Google Analytics, to help us analyze how visitors use the Site. These services track information about visitors including IP addresses, browser types, referring pages, pages visited, and time spent on particular pages, which we use to improve and tailor the user experience on our Site. How We Use Your Information

  • Monitor and analyze trends, usage, and activities of visitors to the Site; or
  • For any other purpose, with your consent.

 In addition, we use certain information collected online through cookies, web beacons, and other automated means for purposes such as recognizing your computer when you visit the Site, tracking your activity as you navigate the Site, or analyzing your use of the Site. We also may use the information we obtain about you in other ways for which we provide notice at the time of collection.

How We Share Information

We may permit vendors, consultants, and other service providers to access information collected through the Site to carry out work on our behalf. For example, we may hire outside companies to help us send emails and manage email campaigns, run survey programs, or host or operate our Site or mobile applications. We also use a service provider to process payments made through the Site. These third party service providers use the personal information to which they have access to carry out the purposes for which we shared the information.

Third-Party Services and Social Features

The Site may include functionality that allows certain kinds of interactions between the Site and a third-party website, platform, tool, application or other service, and accessing or display of third-party content via the Site.  The use of such third-party websites or services may involve the operator of the site or service providing certain information, including personal information, to us.  For example, when you register with the Site, you may have an option to use your Facebook, Google, or other account provided by a third-party site or application to facilitate the registration and log-in process on the Site, or otherwise link accounts.  In addition, you may be able to access our Site via a third party platform, site, app, or other service; the relevant third-party operators may collect personal information and other data about you and may provide some or all of it to us.

Please note that when you use these types of third-party services to log in to the Site, you are using their services – not our Site – and they, not we, are responsible for their practices.  You should review the applicable third party privacy policies before using those services in connection with our Site. 

The Site includes features that are designed to permit interactions that you initiate between this Site and third party websites or services, including third party social networks (“Social Features”). Examples of Social Features include enabling you to log in to the Site with the username and password you use with a third party site or service; to “like” or “share” our content on other websites or services; or to transmit content to our Site from your account on a third party website or service.

If you choose to use Social Features on the Site, information you post or provide access to may be publicly displayed on the Site or by the provider of the Social Feature that you use. Similarly, if you post information on a third party platform that references our Site (e.g., by using a hashtag associated with Freeplay in a tweet or status update), your post may be published on our Site in accordance with the terms of the third party website or service. Also, both Freeplay and the third party may have access to certain information about you and your use of both the Site and the third party site or service. In addition, we may receive information about you if other users of a third party website allow us to access their profiles and you are one of their “connections,” or if information about you is otherwise accessible through those individuals’ profiles or pages on a social networking or other third party website or interactive service.

The information we collect in connection with Social Features is subject to this Policy. The information collected and stored by the third parties remains subject to those third parties’ privacy practices, including whether the third parties continue to share information with us, the types of information shared, and your choices with regard to what is visible to others on those third party websites or services.

Children’s Privacy

The Site is not intended for children, nor is it targeted to children under the age of thirteen (13). We do not knowingly collect personal information from children under the age of 13 through the Site, and if we learn that we have received information from a visitor under the age of 13, we will delete such information in accordance with applicable law.

Links to Other Websites and Services

For your convenience and information, Freeplay may provide links to other websites or online locations in conjunction with this Site or our products and services. Those linked websites may be operated by unaffiliated entities, and may have their own privacy policies or notices. This Policy does not apply to those websites, so we encourage you to learn about their privacy practices by reviewing the privacy policies posted on those sites. We are not responsible for the content or privacy practices of websites that we do not control.

International Users

We are based in the United States and the information we collect is governed by U.S. law. If you are visiting the Site from outside the United States, you are hereby notified that the information we collect through the Site will be processed in the United States. Freeplay does not represent or warrant that the Site is appropriate or available for use in any particular jurisdiction other than the United States. By using the Site, you acknowledge and consent to the transfer and processing of your personal data in the United States as described in this Policy. Please note that the data protection laws and regulations applicable to your personal data transferred to the United States may be different from the laws in your country of residence.

Your Choices

You can help ensure that your contact information and preferences are accurate, complete, and up to date by logging in to your account to make appropriate changes. In addition, you may request that we update, correct, or delete your information collected through the Site by emailing privacy@freeplay.com. To help protect your privacy and security, we may take reasonable steps to verify your identity prior to honoring any such requests.

Many web browsers provide options to allow you to stop accepting new cookies, or to disable existing cookies. Please be aware that if you disable the cookies on your computer you may not be able to use certain features of this Site or other websites, and disabling cookies may invalidate opt outs that rely on cookies to function. Also, these cookie-disabling options may not be effective in all cases, or may be effective with respect to one type of browser or service, but not another.

You may unsubscribe from receiving promotional emails from us by following the instructions provided in those email communications. Even if you opt out of receiving promotional communications from us, we may continue to send you non-promotional emails (such as emails concerning our ongoing business relationship with you).

Security

We maintain appropriate physical, electronic, and administrative safeguards designed to protect personal information that we obtain through the Site. For example, we communicate our privacy and security guidelines to our employees who may access personal information, and we enforce privacy safeguards within the company. Although we use reasonable efforts to secure personal information, transmission via the Internet is not completely secure, and we cannot guarantee the confidentiality of information transmitted to us through the Site.

Changes to this Policy
